Administrative Citation – City of Big Bear Lake Section 2.40.030 provides for the issuance of administrative citations for City of Big Bear Lake violations. There are three levels of administrative penalties that can be issued for a violation. The penalties, as indicated on the front of the citation are $100 (per violation) for the First Citation, $200 (per violation) for the Second Citation, and $500 (per violation) for the Third and subsequent Citations for the same violation occurring within the same year. These penalties are cumulative and citations may be issued each day the violation exists. A warning (if issued) does not incur a penalty and therefore is not appealable. If a warning citation includes a compliance deadline then the violation(s) must be corrected by that date to avoid additional citations and penalties
Payment – Payment must be made in full within 30 calendar days of the issuance of the citation. Payment may be made in the form of a cashier’s check, money order or personal check. Do not send cash. Checks should be made out to the City of Big Bear Lake. Please indicate the address of the violation on your check. Consequences of Failure to Pay the Administrative Penalty - If payment is not received within 30 calendar days of the issuance of the citation, an additional late fee of 50% (Fifty Percent) of the administrative penalty will be added to the amount and must be received within 60 calendar days of the date of issuance of the citation. If the administrative penalty and the late fee are not received within 60 days of issuance of the citation an additional late fee of 50% (Fifty Percent) of the base administrative penalty will be added thereafter.
Right of Appeal – Any Responsible Party to who an administrative citation was issued may contest the citation by filing an appeal within 20 calendar days of the issuance of the citation. In order to file an appeal, a written notice of appeal together with the total amount of the penalty must be sent to the address listed above and received within 20 calendar days of the issuance of the citation. The notice of appeal must include the reasons for the appeal. Except as provided below, the failure to deposit the total amount of the citation penalty, and complete and attached the notice of appeal shall render the appeal incomplete. The Responsible Party shall then be responsible for the total amount of the penalty. A notice of hearing date will be issued upon processing of the appeal request. Note: At the hearing, the City will seek recovery of the administrative citation penalty and administrative costs as provided by the City of Big Bear Lake Code.

This form must be filed with the written notice of appeal and within 20 calendar days of the issuance of the citation.

Consequences of Failure to Pay the Penalty Amount and Correct Violations – The failure of any person to pay the penalty assessed by the Administrative Citation within the time specified on the citation or on the invoice from the City or its designated collection/processing agent may result in Notification of the State Franchise Tax Board, or any agency pursuing legal remedies to collect the unpaid penalties. The payment of the citation does not relieve the responsibility to correct the violation(s) and shall not bar further enforcement by the City.
