Administrative Citation – City of Big Bear Lake Municipal Code Section 17.03.315.L(2)(3)(4) provides for the issuance of administrative citations for City of Big Bear Lake Municipal Code violations. Section 4.01.100 provides for the issuance of administrative citations for City of Big Bear Lake Municipal Code violations and describes the penalties relating to vacation rental violations. These penalties range from $500 to $10,000. Penalties for non-Vacation Rental violations of the Municipal Code range from $100 - $1000. These penalties are cumulative, and citations may be issued each day the violation exists. A warning (if issued) does not incur a penalty and is not appealable. If a warning citation includes a compliance deadline, then the violation(s) must be corrected by that date to avoid citations and penalties.
Payment – Payment must be made in full within 30 calendar days of the issuance of the citation. Payment may be made online at www.CitationProcessingCenter.com or mailed to the address below. Do not send cash. Make checks payable to the City of Big Bear Lake. Please indicate the citation number on your check and enclose a copy of the citation. To Find Your Citation Online – go to www.CitationProcessingCenter.com and pick “Administrative Citation”. Then pick “Citation and Date”. When you type in the citation number, do not use and spaces or dashes. The date is based on the “service date”, which can be found by the signature line on the citation.
Order to Abate Violations – The Responsible Party is hereby ordered to abate violation(s) listed above. Violation(s) must be abated immediately unless a specific correction date has been provided above.
Consequences of Failure to Pay the Administrative Penalty - If payment is not received within 30 calendar days of the issuance of the citation, an additional late fee of $25 will be added to the amount due.
Right of Appeal – An administrativce citation may be appealed by filing an appeal with 30 calendar days of the issuance of the citation. Please do not contact City staff requesting a citation be dismissed, or to argue your side of the case. To file an appeal, a Notice of Appeal and deposit payment must be entered at www.CitationProcessingCenter.com or mailed to the address above within 30 days of the issuance of the citation. The Notice of Appeal must include the reasons for the appeal. Except as provided below, the failure to depost 25% of the citation penalty amount shall render the appeal incomplete. The responsible party shall then be responsible to pay the total amount of the penalty. A Notice of Hearing date will be issued upon processing of the appeal request. Note: at the hearing, the City may seek recovery of the administrative citation penalty and adminsitrative costs associated with the hearing, as provided by the Municipal Code. If you have been issued an administative citation and are unable to deposit the penalty amount at the time of filing the Notice of Appeal, you may request an advance deposit hardship waiver form available at www.CitationProcessingCenter.com. This form must be filed with the Notice of Appeal and within 15 calendar days of the issuance of the citation.
Consequences of Failure to Pay the Penalty Amount and Correct Violations – The failure of any person to pay the penalty assessed by the administrative citation within the time specified on the citation or on the invoice from the City or its designated collection/processing agent may result in the notification of the State Franchise Tax Board, or any agency pursuing legal remedies to collect the unpaid penalties. Payment of the citation does not relieve the responsibility to correct the violation(s) and shall not bar further enforcement action by the City.
